Terms & Conditions – Tempo

1. Introduction
Welcome to Tempo, a ride-hailing platform that connects passengers with professional drivers for safe, reliable, and affordable transportation. By downloading, accessing, or using the Tempo mobile application ("App"), you agree to be legally bound by these Terms & Conditions ("Terms").
These Terms apply to all users of the Tempo platform, including passengers, drivers, and any other individuals who access or interact with our services. Please read these Terms carefully before using the App. If you do not agree to any part of these Terms, you must discontinue use of the App immediately.
2. Definitions
For the purposes of these Terms, the following definitions apply:
- "Tempo" refers to the ride-hailing platform and its mobile application.
- "User" refers to any individual who accesses, registers, or uses the Tempo App, including both passengers and drivers.
- "Passenger" refers to a User who uses the Tempo App to search for and book transportation services.
- "Driver" refers to an independent service provider who uses the Tempo App to offer transportation services to Passengers.
- "Service" refers to all features, functions, content, and ride-hailing services provided through the Tempo App.
- "Account" refers to the registered profile created by a User to access and use the Service.
- "Fare" refers to the cost charged to a Passenger for a completed ride, as calculated by the Tempo platform.
3. User Accounts
a) Account Creation To access Tempo's services, Users must register and create an account. During registration, you agree to provide accurate, complete, and up-to-date information. Providing false or misleading information may result in immediate suspension or termination of your account.
b) Account Responsibilities You are solely responsible for:
- Maintaining the confidentiality of your login credentials
- All activities and transactions carried out under your account
- Notifying Tempo immediately if you suspect any unauthorized access to your account
Tempo will not be liable for any loss or damage arising from your failure to protect your account information.
c) Eligibility To create an account and use the Tempo platform, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Not be barred from using the Service under applicable laws
Tempo reserves the right to deny, suspend, or terminate access to any User at its sole discretion, without prior notice, if eligibility requirements are not met.
4. Services Provided
Tempo operates as a technology platform that facilitates connections between Passengers and Drivers. The following conditions apply:
- Tempo does not directly provide transportation services. All rides are carried out by independent Drivers who are not employees, agents, or representatives of Tempo.
- Tempo does not guarantee the availability of any specific Driver or ride at any given time or location.
- The quality, safety, and conduct of rides are the responsibility of the Driver. However, Tempo takes reasonable steps to vet and monitor all Drivers on the platform.
- Tempo reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
5. Pricing and Payments
a) Fare Calculation Fares are calculated dynamically based on factors including but not limited to:
- Distance travelled
- Duration of the trip
- Current traffic conditions
- Time of day and peak demand (surge pricing)
The estimated fare is displayed before you confirm your booking. By confirming a ride, you agree to pay the fare as calculated at the time of completion.
b) Surge Pricing During periods of high demand, fares may increase. Users will be notified of surge pricing before confirming a booking. Tempo reserves the right to adjust fare rates at any time.
c) Payment Methods Tempo accepts the following payment methods (as available in the App):
- Credit and debit cards
- Digital wallets and UPI
- Cash (where applicable)
By using the Service, you agree to pay all applicable fares and fees in full at the time of the ride or as otherwise specified.
d) Cancellation Policy If a Passenger cancels a ride after a Driver has accepted the request, a cancellation fee may be charged. The applicable fee will be displayed in the App at the time of cancellation. Repeated cancellations may result in account restrictions.
e) Refunds Refund requests are handled on a case-by-case basis. To request a refund, please contact Tempo Support within 48 hours of the completed or disputed ride.
6. User Conduct
All Users of the Tempo platform are expected to maintain respectful, lawful, and safe behavior at all times.
a) Prohibited Activities Users must not:
- Use the App for any unlawful, fraudulent, or unauthorized purpose
- Harass, threaten, or discriminate against other Users or Drivers
- Provide false information during registration or ride requests
- Attempt to manipulate fares, ratings, or any other platform feature
- Use the App to solicit rides outside the platform or engage in unauthorized commercial activity
- Damage, tamper with, or misuse any vehicle used for a Tempo ride
b) Driver Conduct Drivers are expected to:
- Comply with all applicable traffic laws and road safety regulations
- Maintain their vehicles in a clean, safe, and roadworthy condition
- Treat all Passengers with respect and professionalism
- Refrain from using mobile devices while driving
c) Ratings and Feedback After each completed ride, both Passengers and Drivers may rate and provide feedback on their experience. Tempo uses this feedback to maintain service quality. Tempo reserves the right to suspend or permanently terminate any account that consistently receives poor ratings or violates platform standards.
7. Limitation of Liability
To the fullest extent permitted by applicable law:
- Tempo shall not be held liable for any personal injury, loss of life, property damage, financial loss, or any other harm arising directly or indirectly from the use of the Service.
- Tempo makes no warranties — express or implied — regarding the reliability, accuracy, availability, or fitness for purpose of the Service.
- Since Drivers are independent contractors, Tempo is not responsible for the actions, omissions, or conduct of any Driver during a ride.
- Tempo's total liability to any User for any claim arising out of these Terms shall not exceed the amount paid by the User for the specific ride in question.
8. Privacy Policy
Tempo is committed to protecting your personal information. Our Privacy Policy describes in detail how we collect, use, store, and share your data. By using the Tempo App, you consent to the data practices described in the Privacy Policy.
Please review our Privacy Policy within the App to understand your rights and our obligations.
9. Termination
a) By Tempo Tempo reserves the right to suspend or permanently terminate any User's account at any time, with or without prior notice, for reasons including but not limited to:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Risk to platform integrity or User safety
b) By the User Users may terminate their account at any time by contacting Tempo Support or through the account settings in the App. Upon termination, access to the Service and associated data may be permanently removed.
c) Effect of Termination Upon account termination:
- Access to the Tempo platform will be immediately revoked
- Any pending payments or outstanding balances will still be due
- Certain provisions of these Terms (including Limitation of Liability and Dispute Resolution) will survive termination
10. Dispute Resolution
a) Informal Resolution We encourage Users to contact Tempo Support first to resolve any issues informally before pursuing formal proceedings.
b) Arbitration If a dispute cannot be resolved informally, both parties agree to resolve the matter through binding arbitration, conducted in accordance with applicable arbitration rules under the jurisdiction of India.
c) Governing Law These Terms are governed by and construed in accordance with the laws of India. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts located in India.
d) Class Action Waiver Users agree to resolve disputes with Tempo on an individual basis only. Class action lawsuits or group arbitration proceedings are not permitted under these Terms.
11. Changes to the Terms
Tempo reserves the right to update or modify these Terms at any time. When changes are made:
- The updated Terms will be posted within the App
- The Effective Date at the top of this document will be revised
- Continued use of the App after changes are posted constitutes acceptance of the revised Terms

13. Miscellaneous
a) Severability If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
b) Entire Agreement These Terms, together with the Privacy Policy, constitute the entire agreement between you and Tempo regarding use of the Service and supersede all prior agreements, understandings, or representations.
c) No Waiver Failure by Tempo to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision in the future.
d) Assignment Users may not transfer or assign their rights or obligations under these Terms to any third party without prior written consent from Tempo.
